If you are considering a K-1 fiance visa, you are likely trying to figure out how your other wedding plans may be affected or limited by this visa. Our clients often want to know “Where can I get married?” “Can we honeymoon outside of the United States?” It is super important to understand the benefits and limitations of any immigration option before choosing.
The K-1 Fiance(e) visa is a “single entry” visa. That means exactly what it sounds like — you can only use the fiance visa once. There are other visa types that are “multiple entry” visas, but unfortunately the K-1 is not one of them. If you leave the U.S. after you’ve arrived on the K-1 but before you have married and become a legal resident, or at least filed for your legal residence and obtained a travel permit referred to as advance parole, you will no longer have your K-1. You will be right back where you started (or maybe even in a worse position, depending on the circumstances of your departure).
So what is a K-1 visa hopeful to do? Plan on a single entry to the United States, a marriage inside the United States within 90 days of your arrival, and a honeymoon also in the United States. Hawaii is a popular destination since it is a part of the U.S. Just keep in mind that you must avoid any flight that has a layover or a stop in another country on your way to Hawaii! And be aware that you may face additional hassle any time you board a plane. If you plan to travel to Hawaii, check with your lawyer to make sure you have all of the documents you need to show you identity and current immigration status.
Keep in mind that another great option for couples going the K-1 fiance visa route is to do a honeymoon inside the U.S. right after the wedding and plan on a wonderful second honeymoon abroad to celebrate once you receive your green card!
